Welcome to Ozark Home Services. These Terms of Service ("Terms") govern your use of our website and services. By requesting a quote, booking a service, or engaging with our door-to-door sales representatives, you agree to these Terms.
1. Acceptance of Terms
By accessing our website (www.ozarkhomeservices.org), submitting a quote request, signing a service agreement, or engaging with our sales representatives, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
2. Services Offered
Ozark Home Services provides the following seasonal home maintenance services in Northwest Arkansas:
- Gutter Cleaning: Debris removal, downspout flushing, and gutter inspection
- Lawn Mowing: Precision cutting, edging, and lawn maintenance (weekly/bi-weekly plans)
- Christmas Light Installation: Custom design, professional installation, maintenance, and post-season takedown
3. Door-to-Door Sales Agreement
Ozark Home Services conducts direct sales through door-to-door representatives in Northwest Arkansas communities.
⚠️ IMPORTANT - YOUR RIGHT TO CANCEL (Arkansas Cooling-Off Period):
Under Arkansas law (Arkansas Code § 4-89-101 et seq.), you have the right to cancel any contract for services valued at $25 or more that was signed as a result of a door-to-door sale within THREE (3) BUSINESS DAYS of signing, for any reason or no reason at all.
How to Cancel a Door-to-Door Agreement:
- Written Notice: Send written notice of cancellation to Ozark Home Services at blake@ozarkhomeservices.org or mail to our business address in Johnson, AR
- Deadline: Notice must be sent before midnight of the third business day after the contract was signed
- Refund: If you've made any payment, you will receive a full refund within 10 business days
- No Penalty: There are no cancellation fees or penalties
Notice of Cancellation Form: Every door-to-door contract includes a "Notice of Cancellation" form that you can use to exercise this right. Keep this form for your records.
Door-to-Door Sales Conduct:
- Our representatives will identify themselves and present company identification
- All representatives wear branded Ozark Home Services uniforms
- We respect "No Soliciting" signs and "Do Not Knock" requests
- We operate during reasonable hours: 10 AM - 7 PM weekdays, 12 PM - 6 PM weekends
- We never require immediate payment or pressure tactics
4. Quotes and Pricing
All quotes provided (online, by phone, or door-to-door) are estimates based on the information you provide. Final pricing is determined after on-site assessment and may vary based on:
- Actual property size and square footage
- Number of stories and roof pitch
- Condition of gutters, lawn, or property access
- Additional services or special requests
Quote Validity: Online and door-to-door quotes are valid for 30 days from the date of issue. Prices are subject to change after this period.
5. Booking and Scheduling
- Confirmation: All service bookings must be confirmed by Ozark Home Services via email or phone
- Scheduling: We will provide a service window (e.g., "between 9 AM - 12 PM"). Exact arrival times may vary due to weather or previous job delays
- Weather Delays: Outdoor services may be rescheduled due to rain, high winds, or unsafe conditions. We will notify you as soon as possible
- Rescheduling: You may reschedule your appointment with at least 24 hours' notice at no charge
6. Cancellation and Refund Policy
Customer-Initiated Cancellations:
- More than 24 hours before service: Full refund, no fees
- Less than 24 hours before service: 50% cancellation fee may apply
- No-show (customer not home): Full service fee charged unless rescheduled in advance
Door-to-Door Contracts:
- Within 3 business days: Full refund under Arkansas cooling-off law (no fees)
- After 3 business days: Standard cancellation policy applies (see above)
Company-Initiated Cancellations:
- If we must cancel your service, you will receive full refund and priority rescheduling
- No fees will be charged for weather-related cancellations
7. Payment Terms
- Payment Methods: We accept cash, check, credit/debit cards, and electronic payments
- When Payment is Due: Payment is due upon completion of service unless otherwise agreed in writing
- Recurring Services: Lawn mowing plans are billed after each visit or on a pre-agreed schedule
- Late Payments: Accounts over 30 days past due may incur a late fee of $25 or 5% of the balance, whichever is greater
8. Service Guarantees
100% Satisfaction Guarantee: If you're not completely satisfied with our work, contact us within 48 hours and we will return to make it right at no additional charge. This guarantee applies to all services.
What We Guarantee:
- Professional, courteous service from uniformed crew members
- Completion of all agreed-upon work to industry standards
- Clean-up and debris removal (for applicable services)
- Respect for your property and landscaping
Limitations:
- We are not responsible for pre-existing damage to gutters, roofs, or property
- Weather-related grass growth or leaf accumulation after service is not covered
- Damage caused by customer's pets, vehicles, or third parties is not our responsibility
9. Customer Responsibilities
To ensure safe and efficient service, you agree to:
- Provide accurate property information (address, size, number of stories)
- Ensure clear access to work areas (move vehicles, secure pets, unlock gates)
- Disclose any known hazards (wasp nests, damaged structures, underground utilities)
- Be present or provide access to property at scheduled time
- Provide working outdoor electrical outlets (for Christmas light installation)
10. Liability and Insurance
Ozark Home Services carries general liability insurance for property damage and injuries occurring during service. However:
- We are not liable for damage to pre-existing faulty gutters, weak roof structures, or hidden defects
- Customer is responsible for damages caused by failure to disclose known hazards
- Our liability is limited to the amount paid for the specific service in question
11. Prohibited Uses
You may not:
- Use our services for any illegal or unauthorized purpose
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to our systems
- Impersonate Ozark Home Services or our representatives
- Submit false information or fraudulent payment methods
12. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Ozark Home Services and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.
13. Third-Party Services
Our website uses third-party services including:
- Google Maps API: For address autocomplete (subject to Google Terms of Service)
- Payment Processors: For secure payment processing
- Web3Forms: For quote form submissions
These services have their own terms and privacy policies. We are not responsible for third-party practices.
14. Dispute Resolution
Informal Resolution:
If you have a complaint or dispute, please contact us first at (903) 399-5680 or blake@ozarkhomeservices.org. We will work in good faith to resolve the issue quickly and fairly.
Arbitration:
If informal resolution fails, disputes will be resolved through binding arbitration in Washington County, Arkansas, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.
Exceptions:
Either party may seek injunctive relief in court for intellectual property violations or breach of confidentiality.
15. Limitation of Liability
To the fullest extent permitted by law, Ozark Home Services shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits, revenue, or data
- Damages exceeding the amount paid for the service in question
16. Indemnification
You agree to indemnify and hold harmless Ozark Home Services from any claims, damages, or expenses arising from your violation of these Terms, misuse of our services, or infringement of any third-party rights.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
19. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles. Jurisdiction for any legal action shall be in Washington County, Arkansas.
